Trekitt Terms & Conditions

These Terms and Conditions apply to all transactions between Trekitt and yourself. They do not affect your statutory rights. By accessing this website and/or placing an order you agree to be bound by these terms and our Privacy Policy. Please read them carefully.

In these Terms, unless the context requires otherwise:

  • “Trekitt” means the Trek Kit (Hereford) Ltd company and their retail store in the UK.
  • "Contract" means each contract for the supply of Goods by us into which these Terms shall be incorporated.
  • "Card" means the credit or debit card which you use to make payment for the Goods.
  • "Goods" means the goods which we supply in accordance with these Terms
  • "Order" means a purchase order in respect of the Goods issued by you to us

We may change these Terms and Conditions at any time. Any changes will take effect on the date they are posted on our website. These Terms and Conditions are governed by English law and subject to the non-exclusive jurisdiction of the English courts. We do not accept amendments to these Terms and Conditions. Failure by us to enforce any of these Terms and Conditions will not affect our right to enforce the rest of these terms and conditions.

There may be legal notices on other areas of this Website that relate to your use of this Website, such as our Privacy Policy and our Security Policy, all of which will, together with these Terms and Conditions, govern your use of this Website.

Orders

We will treat each order for goods as an offer by you to purchase the goods subject to these terms and conditions.

To order goods on our website, you must be at least 18 years of age and accept our delivery terms.

Users must provide contact information (such as name, delivery address and telephone number) and financial information (such as card number, cardholder address, expiry date and security number).

All orders placed on our website will be acknowledged electronically by e-mail. Please note that verbal and/or electronic acknowledgements do not constitute order confirmation or order acceptance.

In the unlikely event that one or more of the Goods you ordered is unavailable we will immediately refund the value of the unavailable Goods to your original method of payment and inform you by email as soon as possible. Any remaining available Goods on that order will be processed as normal.

Your order will be accepted, and the creation of a legally binding contract between you and us will take place upon delivery provided that we have processed and received payment in full for such Goods.

Trekitt has taken every care in the preparation of the content of this Website, and in particular, to ensure that prices quoted are correct at time of publishing; and that the Goods have been fairly described. However, please note that we may only accept Orders if there are no material errors in the description of the Goods or their prices as advertised on this Website.

Non-acceptance of an Order may be as a result of one of the following:

  • Our inability to obtain authorization for your payment. We may contact you to check your Card details
  • The identification of a pricing or product description error as referred to above.
  • You not meeting the eligibility to order criteria as set out in these Terms.

Whenever we need to contact you, we will use the contact information you have provided.

Prices

The total price payable will be stipulated at the time when you place your order whether or not the order has been acknowledged. We are entitled to make adjustments to the price to take account of any increase in our suppliers' prices, the imposition of any taxes or duties; or if due to an error or omission.

All prices are inclusive of VAT but exclusive of delivery charges which will be payable as indicated at the time the order is placed.

Prices, offers and products are subject to availability and may change before (but not after) we accept your order. If a product becomes unavailable we will inform you.

Discounts in our shop and on our website are applied to the products Recommended Retail Price (RRP).

Although we endeavour to ensure that all pricing information on the website is accurate, occasionally an error may occur and goods may be mispriced. If we discover a pricing error we will, at our discretion: either contact you and ask you whether you wish to cancel your order or continue with the order at the correct price; or notify you that we have cancelled your order. We will not be obliged to supply goods at the incorrect price.

On occasion, the prices payable and promotions offered in respect of goods advertised on the website may differ from those prices and promotions offered at the same time in our shop. We are under no obligation to honour any shop price or promotion in the event that they differ from those on the website. Similarly, our shop is under no obligation to honour any website price or promotion in the event that they differ from those in the shop.

Prices that are reduced for sales and promotions are only valid for the specified period.

Method of Payment

Card

We will not deduct the price from your Card until the Goods are despatched. We may delay despatch until receipt of authorisation for payment to be taken from the Card provided. You can pay using your credit or debit card that is either VISA, Master Card or Maestro. It is imperative that you provide the cardholder's name as it is shown on the card, phone number and address exactly as it appears on the card statement.

Card fraud is illegal and will lead to prosecution in all cases.

Gift Vouchers

Gift Vouchers may be purchased to any value between £5 and £1,000.

Only 1 Gift Vouchers can be used per transaction until further notice.

At the Trekitt Retail Service Centre, Gift Vouchers can be redeemed over multiple purchases until the balance is used up.

On the Trekitt website, Gift Vouchers are redeemed for the total value.

Gift Vouchers are valid for 365 days from date of purchase.

Gift vouchers presented after their expiry date will be treated as void and are non-exchangeable and non-refundable.

To check the remaining balance of your Gift Voucher, please ask in the Hereford Retail Service Centre or contact customer support.

Gift Vouchers cannot be returned or refunded, except in accordance with your legal rights. They should be treated as cash, we are unable to replace a Gift Voucher if lost or stolen. We reserve the right to refuse to accept a Gift Voucher which it deems to have been tampered with, duplicated, damaged or which otherwise is suspected to be fraudulent.

Order Processing

Your order is sent directly to our secure terminals for processing. Once we have received your order and payment, our staff will pick, pack and dispatch the item. We will aim to do this the same day for all orders placed Mon-Fri (excluding Bank Holidays).

Verified by Visa and MasterCard Secure Code. To ensure our mutual security and give you even more confidence in shopping online with Trekitt, we have introduced Verified by Visa and MasterCard Secure Code These services enhance your existing credit/debit card accounts against unauthorized use when you shop with us. To use this service, you must first register with the bank or other organisation that issued your card. Once you have registered and created your own private password with your card issuer, you will be automatically prompted at the checkout when the card is being processed to provide this password each time you make a purchase. Please note that your Verified by Visa and MasterCard Secure Code password is related to your credit/debit cards and is not your Trekitt customer account password. Trekitt does not have access to your Verified by Visa or MasterCard Secure Code password.

Employee access. Our system only allows access to our most senior staff and only in extenuating circumstances (such as investigations of Card Fraud by the Police). Your card information is secure even from their own employees because the systems never display the full card numbers, even on administration screens.

Delivery

We make every effort to deliver Goods within the estimated timescales; however, delays are occasionally inevitable due to unforeseen factors or extreme weather events. Trekitt shall be under no liability for any delay or failure to deliver the Goods within the estimated timescales. Under these circumstances, additional delivery charges will not be refunded. Deliveries to the Channel Islands, Highlands & Islands and N.I. have restrictions on the available services due to the longer distances involved and may take additional time.

Working days - Deliveries will adhere to the timescales indicated provided that the order is placed before 3pm Monday to Thursday (excluding bank holidays). Orders placed on after 3pm Thursday to Sunday will be despatched on the next available working day.

Delivery to your Card address. When you have selected the Goods that you wish to purchase from us, the delivery address will default automatically to the billing address associated with your Card.

Selecting an alternative address. However, should you wish to send the Goods to an alternative address then you can enter this in the delivery address form as you proceed through the checkout process. The alternative address can be either residential or business. To make life easier for you, if you set-up an account with Trekitt then you can store multiple addresses so that when re-ordering you can select from your delivery address book saving you the hassle of filling out the form again.

Delivery charges. The delivery charges are applied according to a simple banding structure based on the value of your total basket. There is only one delivery charge per Order. Our current charges are inclusive of VAT at the prevailing UK rate.

Risk of loss or damage to the Goods shall pass to you at the time the Goods are delivered.

Redirection / Return of Consignment Once Despatched. Unfortunately, we regret to say there is up to a £10.00[GBP] surcharge should the parcel need to be re-routed to a different address once despatched (We do recommend that all orders are sent to an address where a signature is available). This is because we are charged for this service by our couriers and we cannot absorb this cost. We reserve the right to change the delivery prices without prior notice. While we make every effort to ensure that delivery takes place within the stated time scales hours, we cannot fully guarantee any delivery times.

Returns

We hope that you are perfectly happy with your order from Trekitt, but we understand that you may want to return your purchase. We offer a 90-day returns period and endeavour to process all returns within 48 hours of receipt.

The Trekitt Returns Policy Includes...
A 90-day returns period and the Trekitt 2-year Common Sense Guarantee.

Exemptions
PPE (Facemasks, Climbing Equipment etc. ), Food Goods, Socks & Underwear can only be returned if they have not been worn and/or removed from their original packaging with all swing tags still attached. If there is any sign or possibility that the goods have been used, tampered with or contaminated in any way, then we cannot accept a return on the grounds of consumer safety. Zips are typically not covered under a manufacturer's warranty.

The above does not affect the Consumer Contract Regulations.

I want to return an unwanted item

Post it back to us
To return an item to us, you must first:

- Ensure the item is unused and in its original condition (including all label, tags and Boxes)
- Go to the returns page and download, fill in and include a copy of our Returns Form.
- Appropriately package your item in protective packaging, failure to do so will invalidate your rights to a full refund or return (including footwear boxes which can be damaged in transit/customer care if not protected)

Please ensure the service you use corresponds to the size/weight/value of the item. We regret to inform you that we cannot be held responsible for returned goods that become lost in transit or damaged. We therefore strongly recommend that you use a recorded/insured delivery service and keep a record of this and track your item. Once it has arrived at our warehouse, please wait the advised 48 hours for your refund which you will be notified of with a refund receipt sent to your account email. If you have not heard anything after this then please reach out to Customer Support Team [email protected]

Bring it back to us
You can also return internet purchases at the Trekitt Service Centre in Hereford. To speed things along, please bring the Sales Invoice we sent via email as proof of purchase.

If you choose to receive a refund, this will be processed separately by our Customer Support Team.

You may exchange product(s) at the shop for Goods of an equal or higher value for which you will receive a new receipt.

How to do a quick and easy exchange
To exchange online purchases, simply complete a new online order for the desired replacement and return the unwanted Good(s) for a full refund.

Whilst we acknowledge that this is technically not an exchange service, it is by far the most efficient and fastest way to ensure that you receive the goods you require.

You can also exchange internet purchases at the Trekitt shop in Hereford, to speed things along please remember to present the sales invoice supplied by us in respect of such Goods as proof of purchase. You may exchange product(s) at the shop for Goods of an equal or higher value for which you will receive a new receipt.

Trekitt common sense 2-year guarantee

We love this business and take a lot of time personally selecting the products we sell. We are confident that the kit we select is the best currently available, because of this we offer our Trekitt Common Sense 2-year guarantee on every product we sell.

Put simply - if within 2 years a manufacturing fault develops in the materials or workmanship of a product we sold you. We aim to reach a fair and agreed solution, which may be a refund, replacement or a professional repair.

The "common sense" bit. Please don't send us kit that has obviously been used and abused and is completely worn out, and then expect us to replace it. Stuff does wear out, its a fact of life, however, if you feel that your purchase is genuinely faulty please get in touch with us at [email protected]

Warranty Returns (Faulty or Damaged Items)

If you feel that your item is defective/broken/faulty and it is still under warranty, please contact our Customer Support team([email protected])with as much information as possible with regards to the fault, including photos if applicable.

In return, they will supply you with a Returns Authorisation Number (RAN), a Returns Form and a FREE postage label. Please complete the returns form with as much detail as possible and include it with your item.

We cannot make any decisions prior to inspecting any claim. Should the item be found genuinely faulty we aim to reach a fair and agreed solution, which may be a refund, are placement or a professional repair.

Please note that we may need to send the item to the original supplier or a fully certified testing company to seek an independent and professional assessment; this process can take up to four weeks. Also note that zips are typically not covered under a manufacturer's warranty.

THIS BIT IS IMPORTANT! - Items must be returned in a clean and dry condition and be free from dirt: unclean items will be sent back to you. Failure to follow the Warranty Returns procedure may significantly affect our ability to process your return and cause a delay in issuing your refund/replacement/repair.

Consumer Contract Regulations (CCR)

What are the Consumer Contract Regulations?
Under the "Consumer Contract Regulations", you have the right to cancel an order for goods made at a distance. These rights start from the moment you place your order and ends 14 days from the day you receive your goods.

This 14 day period is the time you have to decide whether to cancel, you then have a further 14 days to actually send the goods back.

Your Right to a Refund under CCR
You may get a refund within 14 days of either, the trader getting the goods back, or you providing evidence of having returned the goods (for example, a proof of postage receipt from the post office), whichever is the sooner.

A deduction can be made if the value of the goods has been reduced as a result of you handling the goods more than was necessary.
The extent to which you can handle the goods is the same as it would be if you were assessing them in a shop.

Refunding the cost of delivery
The trader has to refund the basic delivery cost of getting the goods to you in the first place, so if you opted for enhanced service e.g. guaranteed next day, it only has to refund the basic cost.

Exemptions
There are some circumstances where the Consumer Contracts Regulations does not give you a right to cancel.
These include CDs, DVDs or software if you've broken the seal on the wrapping, perishable items and tailor-made or personalised items. They also include goods with a seal for health protection and hygiene reasons that have been broken or tampered with, e.g. Climbing Equipment and PPE.

CustomerRewards

The Trekitt Customer Reward account allows you to earn points while you shop. You can earn points on almost every transaction. However, we do not issue points on Items discounted by 25% or more. The points you earn can be spent on products both online and in our Shop. Points can take up to a day before appearing in your account. You can spend your points as soon as they're on your account. You must register as a Trekitt customer to earn and redeem your points. Registration can be completed online and in the shop.

Customer Reward points are awarded for every £1 spent and are valued at 0.001p per point.

Customer Reward points are a gesture of goodwill and our way of saying thanks for choosing us.

Trekitt reserves the right to amend the number of points earned per £1 without prior notice.

Customer Reward points are awarded on all purchases in the Trekit Shop and on the Trekitt Website, excluding items discounted 25% and over, and the purchase of Trekitt Gift Vouchers, unless otherwise stated.

Customer Reward points can be redeemed at the Trekitt shop and on the Trekitt website.

Customer Reward points are not redeemable for cash.

Customer Reward points are not redeemable against delivery or other service charges.

Reward Points are issued and are redeemable at the sole discretion of Trekitt. Trekitt reserves the right to withdraw reward points or the ability to earn reward points at any time.

The value of Customer Reward Points available when you purchase an item will be displayed on the product page. This value will include any current Customer Rewards Points Offer.

Customer Reward points have a 12 month expiry period. Should there be no activity (earning or spending points) for a rolling 12 month period, your Customer Rewards account balance will be reduced to zero. Your account will remain active for you to earn and spend points in future.

Coupon/Promo Codes & Star Buy Promotions

Only 1 Coupon Code may be used per item, per transaction unless otherwise sated

Coupon Codes can not be used with other Trekitt promotions unless otherwise specified.

Coupon Code discounts apply to the already discounted price of an item.

Selected brands and or items may be excluded.

To claim your discount please enter the coupon code during the checkout stages on the Trekitt website; step 3 of 4 of the checkout when paying by card, or step 4 of 4 if paying by PayPal.

Promotional Voucher Codes can be used with Star Buy Promotions.

Voucher Codes do not apply to delivery charges or any other services unless otherwise specified.

Any refunds will take into account the discount applied as part of the promotion.

Offers are not valid against the purchase of gift vouchers.

Trekitt reserves the right to decline to accept orders where, in its reasonable opinion, a promotion code or discount is invalid for the order being placed or is the subject of fraudulent activity.

Trekitt reserves the right to change these terms and conditions or withdraw a promotion at any time on reasonable notice.

These terms and conditions are governed in accordance with the laws of England and Wales.

When redeeming a gift voucher online, you must use the full value of the voucher on your basket, excluding the cost of shipping. However, if the Gift Voucher is used in the Trekitt Shop, the remaining balance will remain on the same Gift Voucher Code ready for your next purchase.

Warranties and Liability

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence or fraudulent misrepresentation.

In the absence of any negligence other than a breach of duty by Trekitt, your use of any Goods other than in accordance with their operating manuals and/or instructions is entirely at your own risk.

Trekitt will make every effort to deliver Goods within a reasonable time from the date of your Order and to comply with our obligations under these Terms, but we cannot be held responsible for delays or failures due to adverse weather, traffic delays, mechanical breakdowns or other circumstances beyond our control.

The information contained in the material in this Website is only for information purposes. Trekitt, by permitting the use of this Website, does not hold itself out as providing any legal, financial or other advice. It also does not make any recommendation or endorsement as to any investment, advisor or other service or product or to any material submitted by third parties or linked to this Website. Knives and Blades

It is an offence for any person under the age of 18 years to purchase most kinds of knives. We shall only supply knives and related equipment to customers over the age of 18 years. The sale of knives and bladed articles are regulated by law and subject to these Terms. We reserve the right to refuse the sale if we have reasonable cause to believe you are below the age of 18 years, or if we believe that the supply of Goods to you may infringe the law or present an unacceptable potential risk to the safety of others. Our main goal is to promote the safe use of the specialist tools and for this reason, we always take steps to ensure that our knives and tools are promoted in a responsible manner.

The Waste Electrical and Electronic Equipment Regulations (WEEE Regulations)

You can now recycle your old electricals with us. If you’re buying a new electrical item, we will recycle your old one for free.

Why recycle?

Unwanted electrical equipment is the UK's fastest-growing type of waste. Many electrical items can be repaired or recycled, saving natural resources and the environment. If you do not recycle, electrical equipment will end up in landfill where hazardous substances will leak out and cause soil and water contamination; harming wildlife and also human health.

To remind you that old electrical equipment can be recycled, it is now marked with a crossed‐out wheeled bin symbol. Please do not throw any electrical equipment (including those marked with the crossed out wheeled bin symbol in your bin.

What is WEEE?

The Waste Electrical or Electronic Equipment (WEEE) Directive requires countries to maximise separate collection and environmentally friendly processing of these items. In the UK, distributors (including retailers) must provide a system which allows all customers buying new electrical equipment the opportunity to recycle their old items free of charge. Those establishing their own take‐back scheme must as a minimum offer all customers buying new electrical equipment free take-back of their old electricals on a like‐for‐like basis.

Miscellaneous Legal Stuff

A person who is not a party to this agreement shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement. This clause does not affect any right or remedy of any person which exists or is available otherwise than pursuant to that Act.
